  •  December 2018 “Daily Dollars” Promotion
  • 1. Information on how to enter the December 2018 “Daily Dollars” promotion (“Promotion”) and the prizes form part of these Terms and Conditions. Participation in this Promotion is deemed acceptance of these Terms and Conditions.
    2. The promoter is 1Cover Pty Ltd (ABN 91 105 954 265) Authorised Representative of Coffre-Fort Pty Ltd (ABN 66 125 358518) AFS License No 472457 of Level 11, 307 Pitt Street, Sydney, NSW, 2000 and 1Cover NZ Ltd, Company No. 1588084, FSP472306 Level 11, 17 Albert Street, Auckland, 1010, New Zealand.
    3. Entry is only open to residents of Australia and New Zealand aged 18 years or over.
    4. Employees (and their immediate families) of the Promoter and agencies associated with this Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
    5. This Promotion commences at 00:01am AEDT on 01/12/2018 and final entries close at 11:59pm AEDT on 31/12/2018 (“Promotional Period”).
    6. To enter, individuals must complete the following steps during the Promotional Period:
        a. Purchase any Eligible Product in the regions of Australia and New Zealand during the Promotional Period.
        b. Eligible product means a 1Cover travel insurance policy purchased during the Promotional period.
    7. Valid entries:
        a. Incomplete or indecipherable entries will be deemed invalid;
        b. If an insured individual instructs cancellation of their travel insurance policy, their entry will immediately be removed from the competition and they will no longer be eligible to win unless they purchase another Eligible Product.
    8. Multiple entries permitted, subject to the following:
        a. Only one (1) entry permitted per Eligible Product purchased; and
        b. A maximum of one (1) prize per entry per region (Australia and New Zealand).
    9. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
    11. There will be one (1) draw conducted daily for entries in both regions received up to the last date of the Promotional Period (each a “Daily Draw”), for a total of thirty-one (31) Daily Draws. Valid entries will be selected between the Promotional Period open and close dates based on Australian Eastern Daylight Time (AEDT). Refer to clause 5 above.
    12. All Daily Draws will take place at Level 11, 307 Pitt Street, Sydney, NSW, 2000 at 11:00am AEDT. Each Daily Draw will take place on the next day after entries close for that Daily Draw with the exception of the Christmas and New Year holiday period. The first Daily Draw will take place on 02/12/2018, and the last Daily Draw will take place on 04/01/2019. In the event that an invalid or ineligible entrant is drawn, The Promoter may draw additional reserve entries and record them in order.
    13. Winners will be notified by email within two (2) business days of the draw to claim the prize, and their names published online at www.1Cover.com.au or www.1Cover.co.nz.
    14. The Promoter’s decision is final, and no correspondence will be entered into.
    15. For Australia, the first valid entry drawn in each Daily Draw will win AUD$1,000, awarded to the winner being the named policy holder of the Eligible Product and sent to the nominated bank account in the winner’s name via an electronic funds transfer. For the sake of clarity, Australian winners will receive AUD$1,000. For New Zealand, the first valid entry drawn in each Daily Draw will win NZD$501, awarded to the winner being the named policy holder of the Eligible Product and sent to the nominated bank account in the winner’s name via an electronic funds transfer. For the sake of clarity, New Zealand winners will receive NZD$501.
    16. The total prize pool value is up to AU$31,000 and NZ$15,531.
    17. The transfer of the prize will happen within 30 days of the draw subject to the correct bank account details being supplied.
    18. Subject to the unclaimed prize draw Clause 22, if for any reason a winner does not take a prize (or part of a prize) within three (3) months of the draw, then the prize (or that part of the prize) will be forfeited.
    19. If the prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
    20. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless specified otherwise.
    21. If any prize(s) remain unclaimed within three (3) months of the draw, a re-draw for any such prizes will take place three (3) months after the initial draw at the same place as the original draws, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and telephone within (2) business days of the unclaimed prize draw and their names will be published online at www.1Cover.com.au or www.1Cover.co.nz
    22. In the event any prize(s) remains unclaimed within three (3) months of the draw, a re-draw will take place at Level 11, 307 Pitt Street, Sydney, NSW, 2000 at 11:00am AEDT. The final re-draw will take place on 04/04/2019 at Level 11, 307 Pitt Street, Sydney, NSW, 2000 at 11:00am AEDT. In the event that an invalid or ineligible entrant is drawn, The Promoter may draw additional reserve entries and record them in order.
    23. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Promotion (including any outcome), and promoting any products issued and services provided, distributed and/or supplied by the Promoter.
    24. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
    25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia or any statutory consumer guarantees as provided under consumer protection laws in New Zealand (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion.
    26. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and its prize suppliers are not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize.
    27. The Promoter collects personal information (“data”) in order to conduct the Promotion and may, for this purpose, disclose such data to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian or New Zealand regulatory authorities. Entry is conditional on providing this data. The Promoter will also use and handle data as set out in their Privacy Policy, which can be viewed at https://www.1cover.com.au/privacy (for Australian residents) or https://www.1cover.co.nz/privacy (for New Zealand residents). In addition to any use that may be outlined in their Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the data for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrants. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their data, how entrants may complain about a breach of the Privacy Act, report a data breach, or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. Unless otherwise indicated by the Promoter, the Promoter may disclose personal information to entities outside of Australia (see the Promoter’s Privacy Policy for details).
    28. The laws of Australia apply to this promotion to the exclusion of any other law. Entrants submit to the exclusive jurisdiction of the courts of Australia.

  • “#1Coverbrolly Competition” 2018
  • 1. This #1Coverbrolly Competition (Competition) is organised and run by 1Cover Pty Ltd and its associated companies in Australia (Promoter). Participation in this Competition by an entrant is deemed to be an irrevocable and unconditional acceptance of these Terms and Conditions (Terms) by the entrant. Information on how to enter into the Competition, including any prizes awarded, form part of these Terms.

    2. Entry is only open to Australian residents aged 18 years or over. The employees (and their immediate families) of 1Cover Pty Ltd and its associated companies in Australia (collectively, the Promoter) are ineligible to enter the Competition.

    3. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms. Errors and omissions will be accepted at the Promoter's discretion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

    4. The competition commences at 00:01 AEST on 11 October 2018. Entries close at 23:59 AEST on 01 November 2018. 

    5. Upon commencement of the competition 1Cover branded umbrellas will be distributed to members of the public free of charge in the Sydney CBD for a maximum period of three (3) days.

    6. Entrants must submit their entry(ies) by doing each all of the following steps:- Follow 1Cover on Instagram; Upload a photograph or video featuring the 1Cover branded umbrella (refer 5 above) and post to your public Instagram profile; Use the hashtag #1Coverbrolly in the caption of your photograph or video; Tag your post @1Cover

    7. Entrants must make their Instagram profile ‘public’ to enable verification by the Promoter

    8. Entrants may make unlimited entries, but each entry must be a different photograph or video.

    9. Entrants may make their Instagram entry post available on any other media platform, public or otherwise, however, only posts uploaded to Instagram as in section 6 and 7 above will be considered an entry in the Competition.

    10. Without limiting sections 11 to 13 below, incomplete, inaudible or otherwise indecipherable entries (including those of low technical quality) will be deemed invalid.

    11. Each entry (including the recording itself, and the contents of the recording) must be the wholly original work of the relevant entrant. The entry must not be a recording which has been created by a third party or otherwise not created specifically for the Competition. The entrant must ensure that no entry includes third party content – third party content may include things like background music, video footage, literary works or artworks. The Promoter reserves the right to remove any entry from the Portal which, in the Promoter’s opinion breaches, or is likely to breach, this section 11.

    12. Entries must not:

    be obscene and/or offensive; be defamatory or disparaging of another person or entity;  infringe or violate the rights of any third party; or  contain content which is unlawful or illegal 

    The Promoter reserves the right to report to Instagram any entry which in the Promoter’s opinion breaches, or is likely to breach, this section 12. If any entry is reported by the Promoter, the Promoter may also disqualify the entrant who submitted the relevant entry from participating in the Competition.

    13. The Promoter’s right to report any entry to Instagram, and to disqualify an entrant from participating in the Competition, is not limited to the situations set out in sections 11 and 12 above. If, in the Promoter’s opinion, an entry negatively impacts the reputation of the Promoter, subjects any officer or employee of the Promoter to ridicule or is not otherwise in the fun spirit of the Competition, the Promoter shall be entitled to report the entry to Instagram and may disqualify the entrant who submitted the relevant entry from participating in the Competition. The entrant acknowledges and agrees that any entry which is reported to Instagram (whether pursuant to section 11, section 12 or this section 13) shall be deemed an invalid entry and such the entrant shall not participate in the Competition or be considered for any prize.

    14. Entrants must not attempt to interfere with the judging process or approach the Promoter or any of its employees regarding the Competition, whether directly or indirectly, including by any form of social media.

    15. The judging of the entries will commence immediately following the closing date of entries pursuant to section 4, on 01 November 2018 (or any other date as otherwise determined by the Promoter).

    16. The Promoter reserves the right to create a short-list of five (5) entries (based on its own assessment of all the entries submitted).  Short-listed entries will be featured on the 1Cover Instagram for seven (7) days.

    17. Judging of the five (5) short-listed entries featured on the 1Cover Instagram will take place on 02 November 2018 from which the judging panel and its staff will select the winner.

    18. Entries will be judged on the highest number of ‘likes’ each entry receives.  The entry with the most ‘likes’ as at 17:00:00 AEST on 09 November 2018 will be deemed the winner.

    19. The winner will be publicly announced by the Promoter on 12 November 2018 (or any other date as otherwise determined by the Promoter) by publishing the names of the winners on the competition page on its website at www.1cover.com.au and/or any of the Promoter’s social media accounts. The entrant acknowledges and agrees that the Promoter is entitled to publicise the winners of the Competition in any and all media (including without limitation over the radio) for any period of time after the announcement of the winners. The Promoter may request that the winner participate in an interview with a representative of the Promoter in respect of the Competition and the entrant hereby agrees that, if the entrant is selected as a winner, he/she will cooperate with any such request of the Promoter pursuant to this section 19.

    20. The Promoter’s decision in deciding the winners in each of the categories is final and not subject to review, and no correspondence will be entered into by the Promoter regarding the basis on which any decision was made.

    21. The following prize will be awarded in respect to section 6:

           AUD$1,000

    22. The Promoter only accepts entries on the basis that, even if the entrant is registered for GST, no entry will be submitted by the entrant in the course of or in furtherance of the entrant’s own business or enterprise. The Promoter will not add to any prize an amount representing a GST component on that prize when the prize is paid to a winner. The entrant hereby acknowledges that he/she shall not be entitled to any further payment of any sum from the Promoter over and above any prize paid to the entrant pursuant to these Terms and hereby indemnifies the Promoter in respect of any taxes, penalties or other costs which the Promoter may incur or suffer arising out of or in connection with any audit conducted by the Australian Tax Office (ATO) in which the ATO determines that GST was payable on a prize paid to the entrant. This section 22 does not limit the indemnity set out in section 31 below.

    23. A winner will only be paid the prize provided that:

    there has been no breach of these Terms by the winner or in relation to the winning entry; and if required by the Promoter, the winner has signed any legally binding agreement/s and/or documents between the winner and the Promoter consistent with these Terms (without prejudice to section 35 below). Any such legally binding agreement and/or documents will be in the form provided by the Promoter in its complete discretion.

    No compensation shall be payable to any entrant who is chosen as a winner but who is not awarded the prize by reason of this section 21. Further, in the event the entrant breaches these Terms, or the Promoter only becomes aware of such breaches, after any prize has been awarded to the entrant, the Promoter reserves the right to require the entrant to repay and/or reimburse the prize money back to the Promoter and the entrant must do so within seven (7) days of the Promoter’s request.

    24. The prize is not transferable or exchangeable and will be paid to the winner by direct deposit into a bank account nominated by the winner. The Promoter will contact the winner regard payment of the prize; however, if the winner does not respond to the Promoter in a timely manner, or otherwise within fourteen (14) days of the Promoter’s first attempt to contact the winner regarding payment of the prize, the Promoter reserves an absolute right to award the prize to another entrant. Any decision made by the Promoter under this section 24 is final and not subject to review.

    25. The entrant hereby grants to the Promoter an exclusive royalty-free licence of all rights including, without limitation, copyright in and to any and all entries (including as may be deemed invalid in accordance with these Terms) for the full duration of such rights throughout the world in any and all media. The entrant hereby acknowledges and agrees that this section 23 applies to all entries submitted by the entrant, whether or not the entrant or any of the entries becomes a winner.

    26. The Promoter (and its assigns and licensees) has the right (without payment to the entrant) to make unfettered use of any of the entries, and to publish the name and image of any winner, in connection with the Competition and for any promotion, marketing or publicity of the Promoter generally in any and all media worldwide, provided that the Promoter will not hold the entrant out as endorsing any product or service. The entrant hereby gives all necessary consents as may be required to enable the Promoter to exercise the rights herein.  

    27.The entrant agrees that if there are vested in the entrant any moral rights in any entries, the entrant unconditionally and irrevocably waives in perpetuity his/her moral rights or otherwise grants his/her consent to the Promoter doing or omitting to do any act which would otherwise infringe the entrant’s moral rights under the Copyright Act 1968 (Cth) (or analogous laws in other jurisdictions) in relation to the any and all entries, and the entrant will not make any claim in respect of any such action by the Promoter.

    28. The Promoter may (but is not obliged to) reproduce any and all entries across any social media accounts maintained by the Promoter, which include (but are not limited to), Facebook (1Cover Travel Insurance and 1Cover NZ), Instagram (@1cover and @1covernz) and Twitter (@1CoverInsurance and @1CoverNZ) and the entrant provides his/her consent to any such use of the entries in relation to the foregoing. The Promoter is entitled, in relation to such reproductions, to add a ‘top and tail’ to any entry (that is, to include a screen image or short animation promoting the Competition before and after video clip entries). Entries may remain on any one or more of the Promoter’s social media account indefinitely.

    29. If this Competition is affected by error, delayed, interrupted or is otherwise not capable of being conducted as anticipated due to any reason, including if the Promoter chooses to discontinue the Competition at its absolute discretion, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.  For the avoidance of doubt, to the maximum extent permitted by law the Promoter is not liable for any loss or damage that an entrant may suffer in connection with a disqualification and/or the Competition is affected by error, delayed, interrupted, modified, suspended, terminated or cancelled.

Except for any liability that cannot be excluded by law, the Promoter (including their respective officers, employees and agents) excludes any and all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Competition, including, but not limited to, where arising out of the following: (a) any technical difficulties, equipment malfunction or unavailability of the competition portal (whether or not under the Promoter’s control); (b) any circumstances beyond the reasonable control of the Promoter; (c) any theft, unauthorised access or third party interference; (d) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (e) any variation in prize value to that stated in these Terms; (f) any tax liability incurred by a winner or entrant; (g) redemption of the prize (including bank transaction fees) and/or (h) participation in the Competition.

    31. The entrant indemnifies and undertakes to keep the Promoter indemnified from and against any and all actions, claims, proceedings, judgments, demands, liabilities, losses, costs (including reasonable legal costs), expenses and damages which may be brought or awarded against the Promoter or suffered, incurred or paid by the Promoter (howsoever arising) in respect of, arising out of or in connection with the content of an entry submitted by (or on behalf of an entrant) or a breach of the terms, conditions, covenants, warranties and representations (express or implied) contained in these Terms on the part of the entrant.

    32. The indemnity in section 31 above is a continuing obligation which is separate and independent from any other obligations of the parties under these Terms and it survives termination, completion or expiration of the Competition and these Terms.

    33. The entrant acknowledges and agrees that it is not necessary for the Promoter to incur any expense or cost or make any payment before enforcing the indemnity in section 31 above and the entrant will pay any money due to the Promoter under that indemnity on demand by the Promoter.

    34. The Promoter shall not be liable to the entrant or the entrant’s legal representatives for any loss or damage or injury to the entrant or the entrant’s property caused by or suffered in connection with the Promoter’s use or exploitation of the entries.

    35. The Promoter collects entrants’ personal information in order to conduct the Competition and may, for this purpose, disclose such information to third parties (including to its associated companies), agents, contractors and service providers. Entry is conditional on entrants providing this personal information.  By entering the Competition and submitting your personal information you give consent to the Promoter to use your personal information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning you.
